By law, would an airsoft rifle be considered a deadly weapon?

    Assault is about perception.
    If you threaten someone with what looks like a real weapon and they feel threatened by a real weapon, then you have committed assault with a deadly weapon. It doesn’t matter if it’s not a deadly weapon, or even a weapon – the fact that the victim thought it was a weapon is enough to make it an assault.
    If you (as your other questions seem to indicate) want to go around shooting random people with your airsoft guns, you deserve to have the book thrown at you. It’s stupid, irresponsible and downright dangerous.

    Flyinggoldfish is right. It isn’t a deadly weapon because it can’t kill anyone. But hopefully you’ll play with it infront of some police officers and shoot them as a joke–but it’s okay because its not a deadly weapon, therefore you can shoot them without their consent.
    You’re an idiot. You can’t just punch someone because you feel like it. That–as others have stated, is assault/battery.
    Get some common sense and quit giving airsoft a bad name.

    In general, a “deadly weapon” is ANYTHING that can, in the means and manner of its use, cause death or serious bodily injury. Serious bodily injury includes significant disability, like blinding. Where that is the legal test of “deadly weapon,” the decision on a paint ball gun wold probably depend on exactly how it’s used. Same as with a knife or a stick or a shoe or a fist. It’s all in how it’s used. But assault does not require a “deadly weapon.” That just makes it a felony. Poking with a finger is an assault.

    No, it is not because the highest speed a bb shooting out from it legally is 500 fps, which is enough to maybe draw blood, but that’s about it. It might be illegal to have an airsoft gun where you are, but it’s not considered a deadly weapon.

    No , it is a toy. The problems arise when criminals use them to commit felonies, or fatal when they threaten police with one
